Relocating with NFA items...

I have a job that requires me to move every couple of years. It is one of the reasons I have not bothered with pursuing ownership of a suppressor or an SBR. But I really want to own these items. So;

If I had a gun trust drawn up today, would it still be valid / would I be legal if I am relocated to another state in, say, 12-18 months? I reckon part of the answer is "which state." What would be the logistics of the relocation with respect to my NFA items?

Yep, it may depend upon which state. Trusts that are good in one state may not be valid in another. Definitely a question for a lawyer.

Two main issues:
1. Is the trust legal/valid in the new state?
2. Are the NFA items legal in the new state?

ASSUMING the trust is valid in the state you are moving to AND that your NFA items are legal there, you'd just need to send a form 5320.20 to the ATF prior to the move, stating where you and the NFA items are moving to.

Your case may be one where personal ownership is a lot easier to deal with than a Trust (assuming you can get a CLEO to sign). Then, all you'd need to do is make sure the item is legal where you're going, and send the form 5320.

If you had to move to a state where NFA items are not allowed, I think a trust would allow you to legally store the item where and with someone you list on the trust.

Not sure what you do if you personally own a NFA item and have to move to a state that it is not allowed. Does it not have to be in your possession at all times?

Per ATF: Safe deposit box, locked container with a friend/relative, or transfer/sell it.
