Is this radio legal? Meaning, does it have the required FCC label.

If this radio does not have the FCC sticker it is not legal no matter what license you have. By the way, I have the General license.

These radios were put out on the market before the FCC approved them. The FCC has since approved them and allowed them to be labeled as such. Same radio, nothing has changed but no FCC sticker = illegal, with FCC sticker = legal. It is a technicality but one that may get you prosecuted.

Radios need not be type accepted by the FCC for ham usage. If they did, none of the kits I have built would be legal, nor any number of the home built radios in use today.
It is for this reason that amateur radio transceivers are only legal for use on other bands, such as marine, in emergencies.
Yeah, I am a ham, AB8TF, extra class.

I certainly hope you are right. Probably the best option is to check with the FCC.

Ahh...probably not. There are millions upon millions of Baofeng radios in use. The FCC isn't going after users.

And BTW, when I was in Alaska a few years ago the NPS was using Baofengs to contact climbers on Mt. McKinley using GMRS frequencies.
